PLEASE READ THESE TERMS CAREFULLY, AS THEY CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND Team Classie LLC also known as Classie Entertainment Agency.
By accessing or using the Services, you have expressed your interest in Team Classie LLC also known as Classie Entertainment Agency. By using or accessing our services you confirm your agreement to be bound by these terms of use. If you do not agree to these terms, you may not access or use the services. These terms expressly supersede prior agreements or arrangements with you. Team Classie LLC also known as Classie Entertainment Agency may immediately terminate these terms or any services or generally cease offering or deny access to the services or any portion of services, for any reason at any time.
The Terms of Use ("Terms") govern your access or use of services. Team Classie LLC also known as Classie Entertainment Agency and its owner(s), subsidiaries, representatives, affiliates, officers and directors (collectively, " Team Classie LLC also known as Classie Entertainment Agency). Amendments will be effective immediately upon being updated, regardless if the update is posted. Your continued access or use of the services after such posting confirms your consent to be bound by the terms, as amended. If Team Classie LLC also known as Classie Entertainment Agency changes these Terms after the date you first agreed to the Terms (or to any subsequent changes to these Terms), If you reject any such changes by Team Classie LLC also known as Classie Entertainment Agency you are not permitted to use or continue usage of any services, including accessing the website or application.
By using the services of Team Classie LLC also known as Classie Entertainment Agency you agree that any information provided or collection and use of personal information in connection with the services can be used by Team Classie LLC also known as Classie Entertainment Agency in any manner deemed necessary to provide services. The information can also be sold to third parties for marketing and profit. In the case of a data breach you agree to hold Team Classie LLC also known as Classie Entertainment Agency harmless of any liability.
Arbitration Agreement
By agreeing to the Terms, you agree that you are required to resolve any claim that you may have against Team Classie LLC also known as Classie Entertainment Agency on an individual basis in arbitration, as set forth in this Arbitration Agreement. This will preclude you from bringing any class, collective, or representative action against Team Classie LLC also known as Classie Entertainment Agency, and also preclude you from participating in or recovering relief under any current or future class, collective, consolidated, or representative action brought against Team Classie LLC also known as Classie Entertainment Agency by someone else. Arbitration Agreement Between You and Team Classie LLC also known as Classie Entertainment Agency.
You acknowledge and agree, that you are waiving the right to a trial by jury or to participate as a plaintiff or class member in any purported class action or representative proceeding. Team Classie LLC also known as Classie Entertainment Agency and you each retain the right to bring an individual to small claims court. Team Classie LLC also known as Classie Entertainment Agency and you have the right to seek injunctive or other equitable relief in a court of law.
You agree arbitration will be administered by an administration selected by Team Classie LLC also known as Classie Entertainment Agency in a jurisdiction selected by Team Classie LLC also known as Classie Entertainment Agency .
The parties agree that the arbitrator selected is the final ruling. You agree no federal, state, or local court or agency, shall have exclusive authority to resolve any disputes relating to the interpretation, applicability, enforceability or formation of this Arbitration Agreement, including any claim that all or any part of this Arbitration Agreement is void or voidable. The Arbitrator shall also be responsible for determining all threshold arbitrability issues, including issues relating to whether the Terms are unconscionable or illusory and any defense to arbitration, including waiver, delay, laches, or estoppel. You agree to pay any arbitration fees.
Indemnity
You agree to indemnify and hold Team Classie LLC also known as Classie Entertainment Agency and its affiliates and the officers, directors, employees, and agent of Team Classie LLC also known as Classie Entertainment Agency harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys' fees), arising out of or in connection.
Your use of the services and good of services is at your own risk. You agree not to breach or violate any of these terms. You agree not to violation of the rights of any third party, including Third Party Providers.
Changes
No changes to this agreement are valid without the express written consent of Team Classie LLC also known as Classie Entertainment Agency. You agree to all updates of any terms and conditions that are made by Team Classie LLC also known as Classie Entertainment Agency.
Services
The Services comprise website and mobile applications and related services, which enable users to arrange and schedule hospitality services, bartenders, food servers, event staff, logistics and/or delivery services and/or to purchase certain goods, including with third party providers of such services and goods under agreement with third party providers and/or Team Classie LLC also known as Classie Entertainment Agency or certain of Team Classie LLC also known as Classie Entertainment Agency affiliate. Bartender services are offered with gratuity payment options. Option number one is clients can pay upfront gratuity based on current market rate. Option number two client can allow guest to make gratuity minimum payment via tipping directly to bartender via jar. If guest tipping does not meet or exceed current market rate gratuity minimum,client agrees to pay the balance of market rate gratuity minimum. Market rate gratuity is listed when booking bartender. Client fully agrees to these terms to book services. Gratuity minimum applies, per bartender.
The Services may also include options to receive transportation, logistics and/or delivery services for an upfront price. Unless otherwise agreed by Team Classie LLC also known as Classie Entertainment Agency in a separate written agreement with you, the Services are made available solely for your personal, noncommercial use.
Restrictions
You may not attempt to access, modify or use without consent the logo, name, trademarks or false impressions of Team Classie LLC also known as Classie Entertainment Agency or any services, customers, third party affiliates or subcontractors.
Services by Third Party Affiliates
The Services of Team Classie LLC also known as Classie Entertainment Agency may be made available in connection with third party services and content. You acknowledge that Team Classie LLC also known as Classie Entertainment Agency does not control the polices of these companies and how information is used through them. The actions of third party affiliates are not controlled. By using services you agree to hold Team Classie LLC also known as Classie Entertainment Agency harmless of all actions.
Rights
All services and rights to service will remain the property of Team Classie LLC also known as Classie Entertainment Agency. You acknowledge that use of services does not grant you any rights
Restrictions
You agree Team Classie LLC also known as Classie Entertainment Agency cannot be held liable for service malfunctions and delays for any reason. To access our services you must be a minimum of 21 years of age and agree to all terms of service. Our service is not authorized to be used by anyone under the legal age of 21. You agree to comply with all local applicable laws. You agree Team Classie LLC also known as Classie Entertainment Agency is authorized to contact you by any method provided including, telephone or text. If you do not want contact written consent must be provided. You understand you are full responsible for any network or data charges that may apply.
Payment
Using services will result in charges to the credit card or electronic form of payment placed on file. Charges will include taxes and fees. Team Classie LLC also known as Classie Entertainment Agency reserves the right to remove and/or revise charges for any or all services or goods obtained through the use of the services at any time.
You can request to cancel services at any time. Any service cancellation will result in No Refunds on all deposits paid and No Refund on any funds paid for any service. In certain instances Team Classie LLC also known as Classie Entertainment Agency can render a credit to your account, at the sole discretion of Team Classie LLC also known as Classie Entertainment Agency. If Team Classie LLC also known as Classie Entertainment Agency declares a cancellation of client services for any reason including for reasons of: inappropriate client conduct, No Refunds on deposits paid and No Refund on any funds paid for any service will be rendered. Inappropriate conduct (“inappropriate”) defined by the person receiving the behavior and company policy to include: sexual comments, unwanted comments, touching, sounds behavior, rudeness, demands, raising of the voice, threats of any kind, gestured, eyeball contact, phone call harassments, email or anything such).
Limited Liability
You agree Team Classie LLC also known as Classie Entertainment Agency cannot be held liable for any liability regardless of any negligence (sole, concurrent, affirmative, either active, ANY, NONE). You agree Team Classie LLC also known as Classie Entertainment Agency can not be held to any liability, of any kind, even if Team Classie LLC also known as Classie Entertainment Agency has been made aware of any possibility of damages, safety, misconduct of any kind.
You agree Team Classie LLC also known as Classie Entertainment Agency cannot be held liable for any use of service, any losses due to use of the service, transaction or relationship between you and any third party provider (bartenders, servers, event staff, consultants), delays or failure to perform.
Team Classie LLC also known as Classie Entertainment Agency does not affirm third party licenses. Some third party provides license may not exist. You agree not all third party affiliates are professionally licensed. You agree not all third party affiliates are insured. By using our services you acknowledge and accept these terms. You agree to hold Team Classie LLC also known as Classie Entertainment Agency harmless. All services provided are “AS IS”.
Team Classie LLC also known as Classie Entertainment Agency shall not be held liable for any indirect, punitive, incidental damages of any kind to include: lost information, personal property, profits, data. All services provided by Team Classie LLC also known as Classie Entertainment Agency are “AS IS”. You agree the entire risk of using the goods and services is solely at your own risk. You agree there is no guarantee of services, timeliness or error-free service. You agree Team Classie LLC also known as Classie Entertainment Agency does not guarantee the quality, uninterrupted service or safety of anyone. All services and goods provided through Team Classie LLC also known as Classie Entertainment Agency have a security and safety risk that you agree is entirely on you. No guarantee of your security of safety is offered. Services and goods are offered are “AS IS”. You agree Team Classie LLC also known as Classie Entertainment Agency and the owner, offer no guarantee of services, safety protection, all services provided are “AS IS”.
You agree services may be used by you to request bartenders, servers, event staff, coordinators, goods and general services with third party providers. You agree that Team Classie LLC also known as Classie Entertainment Agency has zero responsibility or liability to you related to any services or good provided to you by any third party provider.
